For the moment, as the Victims, Witnesses and Justice Reform Bill moves into Stage 2 of parliamentary process, the majority of MSPs has either abstained (62, of whom 6 SNP) or not voted (7). So the referendum argument isn’t settled yet…
…only 1 MSP has to file an amendment and then the Criminal Justice Committee has to consider it. If the CSJ so decides, then the amendment must be debated by Parliament.
Then things become very interesting when MSPs have to decide, publicly, who they really represent.

No-one with any genuine insight into Scottish politics would describe the SNP of the last 10 years as pro Independence. As for licking the arse of the extreme economic and social liberal EU their actions run counter to their occasional and vague statements on the issue.
